[이천석의 사설] ‘4심제’ 논란과 입법 독주, 국회 해산으로 국민의 직접 심판을 물어야

민주주의의 근간인 삼권분립이 위태롭다. 최근 야당이 추진하는 이른바 ‘4심제’ 입법 시도는 사법부의 독립성을 흔들고 전체주의적 발상이라는 비판을 피하기 어렵다. 국가의 근간을 바꾸는 중대 입법이 국민적 합의 없이 다수당의 위력으로 강행된다면, 그것은 더 이상 민주적 입법이 아닌 ‘입법 폭거’에 불과하다.

거리로 나설 수밖에 없는 야당의 결단

제1야당인 국민의힘은 이제 결단해야 한다. 원내 협상이 무의미해진 상황에서 의원직 사퇴라는 배수진을 치고 광장으로 나가 국민과 함께 투쟁하는 것이 대한민국을 올바른 길로 되돌리는 유일한 길일지 모른다. 국회 안에서의 무력한 항의보다, 주권자인 국민 곁에서 입법의 부당함을 알리고 직접 호소하는 정공법이 필요한 시점이다.

대의제 실패와 국회 해산의 당위성

현재의 국회는 지난 총선 과정에서 불거진 각종 부정선거 의혹으로 인해 그 정당성이 끊임없이 도전받고 있다. 국민의 불신이 가득한 상황에서 국가의 운명을 결정할 중대 사안을 현 국회에 맡겨둘 수는 없다.

• 입법 정당성 확보: 민주당이 추진하는 법안들이 진정 국민을 위한 것이라면, 국회를 해산하고 새로운 선거를 통해 국민의 직접적인 심의를 받아야 한다.

• 선거의 효율성: 다가오는 6.3 지방선거와 국회의원 총선거를 동시에 실시함으로써, 국민의 준엄한 심판을 묻고 국정 운영의 새로운 동력을 얻는 것이 타당하다.

결론: 국민만이 정답이다

민주주의에서 정당성의 원천은 오직 국민에게서 나온다. 다수 의석을 무기로 한 일방통행식 입법은 결국 국민의 저항에 직면할 수밖에 없다. 지금의 국정 혼란을 수습하고 대한민국이 다시 도약하기 위해서는, 낡은 국회를 해산하고 주권자의 뜻을 다시 묻는 정공법이 필요하다. 그것만이 민주당도 정당성을 얻고 대한민국도 바로 서는 길이다.

The recent push by the opposition to legislate a so-called "Fourth Instance" system is a dangerous attempt to shake the independence of the judiciary and is indistinguishable from totalitarian ideology. If a fundamental shift in the nation’s legal framework is forced through by a majority party without public consensus, it ceases to be democratic legislation and becomes "legislative tyranny."

The Necessity of Opposition Resolve: Taking the Fight to the Streets

The People Power Party must now make a definitive choice. In a climate where parliamentary negotiation has become meaningless, resigning their seats and taking to the streets to fight alongside the citizens may be the only way to return South Korea to the right path. Rather than futile protests within the halls of the Assembly, a frontal approach—appealing directly to the sovereign people and exposing the injustice of this legislation—is required.

The Failure of Representation and the Justification for Dissolution

The current National Assembly faces constant challenges to its legitimacy due to lingering suspicions of election irregularities from the last general election. In a state of profound public distrust, the fate of the nation cannot be left in the hands of the current legislature.

• Securing Legislative Legitimacy: If the bills proposed by the Democratic Party are truly for the people, they should dissolve the Assembly and seek a direct public review through a new election.

• Election Efficiency: By holding a general election concurrently with the June 3rd local elections, the nation can seek a stern judgment from the voters and gain new momentum for state administration.

Conclusion: The People Are the Only Answer

In a democracy, the source of legitimacy lies solely with the people. Unilateral legislation fueled by a majority of seats will inevitably face public resistance. To resolve the current political chaos and allow South Korea to leap forward once more, we must adopt the "frontal breakthrough" of dissolving the outdated Assembly and asking for the will of the sovereign people. Only then can the Democratic Party claim legitimacy, and only then can South Korea stand tall again.
