[이천석의 사설] '법치 실종'의 아수라장, 자유민주주의의 근간이 무너지고 있다

대한민국 정치가 유례없는 혼란의 소용돌이에 휘말렸다. 국가의 기틀인 법치주의와 정당한 적법 절차(Due Process)는 사라지고, 오직 권력의 입맛에 맞춘 '사법의 정치화'와 '정치적 보복'만이 횡행하고 있다. 최근 전한길 강사에 대해 자행된 공권력 집행 과정은 그 정점이며, 이는 우리가 쌓아온 자유민주주의의 가치를 뿌리째 흔드는 일이다.

거꾸로 가는 법치, '망신 주기'식 공권력의 폭주

가장 경악스러운 대목은 국민적 인지도를 가진 교육자에게 가해진 무도한 체포 과정이다. 헌법상 무죄 추정의 원칙은 차치하더라도, 구속적부심의 결과가 나오기도 전에 수갑을 찬 모습이 대중에 여과 없이 노출된 것은 명백한 '인격 살인'이자 정치적 의도가 다분한 연출이다. 유죄 판결이 나지 않은 시민을 범죄자 낙인부터 찍고 보는 행태는 과거 권위주의 시절로의 회귀와 다름없다. 국가 권력이 정당한 법 집행을 넘어 개인의 존엄성을 훼손하는 도구로 전락했다는 비판을 피할 수 없다.

'방탄 국회'와 '사법 무력화', 민의의 전당은 어디 있는가

입법부의 모습은 더욱 점입가경이다. 국회 청문회와 상임위 현장은 민생을 논하는 자리가 아니라, 특정 정치인을 수호하기 위한 '방탄의 성역'으로 변질되었다. 서영교 의원을 비롯한 거대 여당 의원들이 보여주는 행태는 국민의 눈에는 오직 '이재명 무죄 만들기'를 위한 사법 방해 행위로밖에 보이지 않는다.

국회가 개별 정치인의 형사 책임을 가리는 변호인단 역할을 자처하는 현 상황은 대의제 민주주의의 수치다. 법 앞의 평등이라는 대원칙을 무시한 채, 특정 세력의 안위를 위해 국가 시스템을 마비시키는 행위는 대한민국을 '미개한 국가'의 수준으로 격하시키고 있다.

아수라가 된 대한민국, 다시 기본으로 돌아가야 한다

세계가 부러워하던 선진국 대한민국이 어쩌다 이토록 참담한 지경에 이르렀는가. 대통령과 정치권이 사법 정의를 사유화하고, 지지 세력의 결집을 위해 법치를 도구로 삼을 때 그 고통은 고스란히 국민의 몫이 된다.

지금 필요한 것은 통탄 섞인 분노를 넘어선 엄중한 경고다. * 사법 당국은 정권의 하수인이 아닌 법과 양심의 파수꾼으로 돌아와야 한다.

권력은 유한하지만 법과 정의는 영원해야 한다. 지금처럼 사법 시스템이 특정 정파에 의해 유린당하는 '아수라 대한민국'을 방치한다면, 우리 후손들에게 물려줄 미래는 암담할 뿐이다. 위정자들은 작금의 혼란에 대해 역사와 국민 앞에 무거운 책임을 져야 한다.

The Republic of Korea has been thrust into an unprecedented whirlwind of political turmoil. The fundamental principles of our nation—the rule of law and due process—are vanishing, replaced by the "politicization of the judiciary" and "political retaliation" tailored to the whims of those in power. The recent exercise of public power against lecturer Jeon Han-gil is the pinnacle of this disorder, shaking the very roots of the liberal democratic values we have built.

Public Power Running Amok: The "Public Shaming" That Reverses Legal Progress

The most shocking aspect is the brutal arrest process carried out against an educator with high public recognition. Even setting aside the constitutional principle of the "presumption of innocence," the fact that footage of him in handcuffs was broadcast to the public before the results of the warrant review were finalized is a clear "character assassination" and a staged performance with heavy political undertones. This practice of labeling a citizen as a criminal before a guilty verdict is reached is no different from a regression to past authoritarian eras. The state cannot escape the criticism that it has turned public power into a tool for violating individual dignity rather than a means of legitimate law enforcement.

A "Bulletproof Parliament" and the Neutralization of Justice

The situation in the National Assembly is even more deplorable. The halls of parliamentary hearings, which should be venues for discussing public welfare, have devolved into "sanctuaries of protection" for a specific politician. The actions shown by members of the majority ruling party, including Representative Seo Young-kyo, appear to the public as nothing more than a desperate struggle to obstruct justice and fabricate a "not guilty" narrative for Lee Jae-myung.

It is a disgrace to representative democracy that the National Assembly has voluntarily taken on the role of a legal defense team for an individual politician's criminal liability. These actions, which ignore the grand principle of equality before the law to ensure the safety of a specific faction, are degrading the Republic of Korea from a developed nation to the level of an uncivilized state.

A Republic in Shambles: A Return to Basics is Mandatory

How has the Republic of Korea, once an object of global envy, fallen into such a disastrous state? When the President and the political circles privatize judicial justice and use the rule of law as a tool to mobilize their supporters, the burden of suffering falls entirely on the citizens.

What is needed now is a stern warning beyond mere lamentation and anger.

• The Judicial Authorities must return to being the guardians of law and conscience, not the handmaidens of the administration.

• The Political Circles must break free from the shackles of "bulletproofing" and remain faithful to their inherent duties as constitutional institutions.

Power is finite, but law and justice must be eternal. If we continue to neglect this "Asura-like Republic" where the judicial system is desecrated by specific political factions, the future we hand down to our descendants will be bleak. Those in power must bear heavy responsibility before history and the people for this current state of chaos.
